General conditions
General
sales conditions define the environment for the selling interaction
between 'Effetto Mariposa di De Gioannini Alberto' (from now on:
Seller) and the Customer. What follows apply to all sales done by the
Seller, for any product sold on www.effettomariposa.com.
As a consequence, the order done by any Customer for any product sold
by the Seller presumes the full and complete acceptance of present
Sales Coditions, of whom the Customer declares having had a clear
understanding before the order.
Effetto
Mariposa's products are offered for sales worldwide.
The Customer declars having the full juridic capacity than is a necessary condition to involve
him/herself with the present conditions of sales.

Prices
Prices
of products are the ones expressed on the Order Form available on
www.effettomariposa.com website. Shipping prices, also on the Order
Form, should be added to the product price to obtain the final
price. For Europe, prices include VAT. Any change to the VAT will be
immediately transfered to the prices. Prices are subject to change in
any moment. Eventual changes will be notified to the customer before
accepting the order.
Privacy
Access
and navigation into www.effettomariposa.com don't require any
registration. Personal Data are requested to the Customer, through the
Order Form, in case he/her decides to proceed to buying products
offered on the website. These Data are subject to the Italian law "Tutela
della persona e di altri soggetti rispetto al trattamento dei dati
personali" (D.L.gsvo 30.6.2003 n. 196), known as Privacy law.
Personal data will be used
within the Seller's activity for:

all
practices linked and needed for the interaction with the Customer
(internal statystics, customer-satisfaction feed back, acquisition of
information to allow the selling interaction requested by the Customer,
etc.);
- finalities related to
compulsory actions asked by the existing Italian laws;
Customer
enjoys all the rights expressed in art. 13 of D.L.gsvo 30.6.2003 n.
196, like: right to ask the Seller about the existance of his/her
personal data in the Seller's database; to know origin, logics and
finalities of their processing; to obtain their update, correction and
integration; to obtain their cancellation in case of illecit usage; to
oppose against their use for sending of advertising material, market
research, direct sales, commercial interactive communication. All this
can be requested and obtained by the Customer sending a written note to
the address listed under 'Seller's Identity'.
Delivery OF goods purchased on www.effettomariposa.com We invite you to check the integrity of goods when receiving the
delivery. In case you find any anomaly, please contact urgently sales@effettomariposa.com.
Effetto Mariposa is not responsible for delays due to the courier's
fault. Delays give no right to refunding. The loss of goods by the
courier gives right to the Customer to receive again the same goods,
letting anyway Effetto Mariposa the time to organise the re-shipping.
The right to change your mind (right to
receed from the contract)
Internet sales are disciplined by Italian Law D.Lgs
n. 185 del 22/05/1999
ruling 'remote' contracts, those contracts not signed in physical
commercial areas. This
law includes for all the physical Customers the right to receed from
the cotract and send back the products they bought, getting a
rembursment of what paid.
This right is not extended to legal entities or to customers acting
within their professional activity.
To enjoy this right, the Customer has to send back, within 10 working
days from receiving the goods, a written note expressing the will to
receed from the buying contract. The only cost for the Customer is
shipping expenses to send back the goods.
This right cannot be enjoyed if the goods are not in acceptable
conditions, which means:
- lack of original packaging
- absence of parts of the
products (screws, instruction manuals etc.)
- product damages
not due to transportation
Reeceding
from the contract: procedure
In case the
Customer wants to receed from his/her buying contract, he/she should
follow this procedure:
-
Send
the Seller, within 10 working days from receiving the goods, a written
note expressing the will to receed from the buying contract.
Anticipating this note with an e-mail or telephone call is recommended.
The written note should contain the coordinates of Customer's bank
account.

Using
an express courier, send back the products, carefully packed and
in acceptable conditions (see above).

Insurance
should be made on the shipment, at the Customer's expensed.
If the product is insured for a value lower than what originally payed
by the Customer, in case the product is damaged during the shipment
Effetto Mariposa reserves the right to charge the Customer for the
damages, subtracting this amount from the sum to remburs.

Effetto
Mariposa will issue a wire transfer on the Seller's bank account for
the amount originally payed by the Customer, within 14 working days
from the shipment of goods by the Customer, but not before the arrival
of the goods.
Warranty
and defects
According to Decreto
Legislativo n° 24 of
02-02-2002,
Effetto Mariposa is responsible for any conformity defects existing at
the moment of delivery of goods bought by the Customer on
www.effettomariposa.com website.
Conformity defect could be:
- a functional defect
- internal damage due to
transportation
- shipping of wrong product
A
conformity defect should be notified within 24 months after the buying
date and within 2 months after the defect showed up.
Warranty applies to products showing conformity defects and/or
malfunctioning not evident at the moment of buying, assuming that the
product has been used correctly and with the due care, respecting its
destination and all what recommended in the instruction leaflet.
Warrany won't apply in case of negligence, lack of care in use and
storage, eventual modification and tuning not requested by the
manifacturer etc...
In case of conformity defect, the Customer has right to have the
conformity of his/her product restored through reparation or
replacement.
Warranty is personal and will apply only to the original buyer, being
reserved to direct Customers and not to resellers.
Warranty
procedure
In case a
product bought from Effetto Mariposa had conformity or functional
defects, the Customer should follow this procedure:
-
Tell
(letter, e-mail, telephone) Effetto Mariposa, within 24 months after
the buying date, the problem

Wait for the e-mail with the
instructions on how to send back the product
-
Pack and send the product,
as complete as possible of all its original parts
-
After
receiving and checking the product, Effetto Mariposa will proceed to
restore its functionality, then send it back to the Customer without
any additional expese for him/her.
Notes
For anything
not listed on www.effettomariposa.com regarding juridic aspects,
existing laws and norms apply.
Product data and technical characteristics may change without notice.
Any reproduction, partial or complete of this website is forbidden by
law and will be persecuted by competent authorities.
